  6. The Swiss Federal Data Protection Act (FADP, SR 235.1) regulates the processing of personal data by the Federal Administration. Articles 57h et seq. of the Government and Administration Organisation Act (GAOA, SR 172.010) regulate the processing of personal data and legal entities’ data. It applies to data processing in connection with the use of the dLIS web application.

  8. By using the CH-Login or AGOV-Login to access the dLIS web application, you consent to the collection, processing and use of your data. The dLIS web application is used to manage online applications for licences for pilots (FCL), maintenance personnel (AML), air traffic control officers (ATCO/SRT), operators of unmanned aircraft systems (UAS) and UAS-related organisations. Personal data and legal entities’ data required for the administration and issuing of licences and authorisations are recorded and processed. These are the following data in particular:

    • Identification data (e.g. name, address, date of birth, company, UID number)
    • Contact information (e.g. e-mail address, telephone number)
    • Payment information
    • Technical data (e.g. IP addresses, cookies)
    • Usage data (e.g. web tracking)
    • Special categories of data (e.g. information on licences and authorisations, invoice data), insurance data

    These data may include inventory and contact data, browser and device data, content data, licence data, meta or marginal data and usage data, location data, sales, contract and payment data.

  10. Data collection and processing serves the following purposes:

    • Processing applications for licences and authorisations;
    • Providing an identification number for registered drone operators;
    • Providing suitable online training and testing;
    • Disclosure of information to law enforcement agencies if required by law.

Personal data and legal entities’ data may be passed on to third parties if this is required by law (in particular in response to requests for legal assistance or in criminal or administrative proceedings). Third parties in this case are authorities and organisations that are obliged to guarantee the same minimum level of data protection as the FOCA, e.g. the police, cantonal authorities, aviation authorities of other EU member states or third countries.

  14. The data are stored in Switzerland. The FOCA is not responsible for the content of third-party websites to which it provides links.

  15. Duration of storage
  16. The FOCA stores personal data for as long as required in order to use the dLIS web application and in accordance with the legal requirements.

The FOCA takes appropriate security precautions both of a technical nature (e.g. encryption, logging, access controls and restrictions, data backups, IT and network security solutions) and of an organisational nature (e.g. instructions to employees, confidentiality agreements, checks,) to protect data from unauthorised access, loss or misuse.

  20. You have the following rights in relation to the collection and processing of your data:

    • the right to information about which personal data and legal entities’ data are stored and how they are being processed;
    • the right to have a copy of your personal data and legal entities’ data provided or transferred to you in a commonly used format;
    • the right to the rectification of your personal data and legal entities’ data;
    • the right to the deletion of your personal data and legal entities’ data;
    • and the right to object to the processing of your personal data and legal entities’ data.

    Statutory requirements and exceptions apply to these rights. Where permitted by law, a request to exercise these rights may be refused. You have the right to file an appeal with the competent data protection supervisory authority.
