These Terms and Conditions (T&Cs) govern the use of the dLIS web application of the Federal Office of Civil Aviation (FOCA) for registration in the Drone Operator Register as well as for the electronic submission of applications and related services.
Using the web application requires registration via the official Swiss government login (CH-Login or AGOV). Access is permitted only for registered users.
Fees are charged for registration in the Drone Operator Register, the processing of applications, and the issuance of licenses, permissions, or approvals, in accordance with the Ordinance on Fees of the Federal Office of Civil Aviation (GebV-BAZL, 748.112.11). The fee amount is displayed during the application process. The fees must be paid electronically and in advance. Accepted payment methods include: Credit cards (e.g., Mastercard, Visa, and American Express), PostFinance Pay, PostFinance Card, and TWINT. Users have three attempts per payment for the drone certification exams.
Paid amounts for purchased services are generally not refundable. This applies in the case of unexcused absences (no-shows) from theory exams, radio telephony exams, and language exams at the center. If a medical certificate for an illness-related absence from an exam is provided, the exam fee will be credited and available for another booking in the same subject. Paid amounts for drone theory exams are generally not refundable.
Users agree to provide truthful and complete information during the application process. False information may have legal consequences. Users are also obligated to update their data regularly. Any damages arising from outdated or incorrect information are the responsibility of the user.
Users agree to use the services in accordance with the terms of use and refrain from any illegal usage. Violation of the terms of use may result in the (temporary) suspension of the account. Users are liable for any resulting damages.
Liability claims against FOCA for material or immaterial damages which arise from the access to or the use, or rather non-use of the services, misuse of the connection, or technical malfunctions, are excluded. Damages that can arise from internet usage are waived. In all other cases, liability is limited to gross negligence. FOCA is not liable for third-party claims for compensatory damages or other claims, or for consequential damages or damages due to loss of profit, unrealised profits, unrealised savings or loss of earnings. FOCA reserves the right to modify these T&Cs at any time. Changes will be communicated to registered users in an appropriate manner.
Swiss law applies exclusively to all legal disputes related to the use of the web application. The jurisdiction is Bern.
